    You're half right. Neither character involved is what you'd call a "sympathetic character".

    We can only use deadly force in self defense against an imminent/immediate threat of grave bodily harm or death though not in retaliation.

    McNaughton had retreated and was turning away when shot thus there was no imminent/immediate threat.

    When you pickup a gun you have to turn off your emotions and know the law or you end up spending most of the rest of your life behind bars or worse.

    For the sake of clarity... Drejka's lawyers never invoked the stand your ground statute. They went on record to that effect.
    It was never a factor in this case.

    IF you look closely at the video, after being shoved, the black guy made a motion TOWARDS Draeka. Only after Draeka drew his weapon and ONLY then, did the black dude back off.

    At that moment, the weapon and its threat should have ended right then (without any shots being fired). I am not saying anyone was right nor wrong. The only thing I have just stated was that the black dude made a move (almost un-noticed) towards Draeka. This move only stopped and reversed when Draeka aimed his weapon.

    Who da hells knows what the black dude would have continued doing if not for his decision to "back off"?

    I have watched the replay many times since the verdict. The black guy made a move which I explained in the post above this one. I never noticed this move before. I was to involved in watching the black dude get shot.

    He wasn't being threatened. He's been knocked down and the man wasn't coming after him. I'm sure he felt great screaming at the woman but her boyfriend took exception. He pushed the man, the man fell down, and then drew his gun and shot the other man as he backed away.

    It's a good thing the woman didn't get out of the car and slap him. He might have shot her, too.

    I think he's lucky he got manslaughter.
