    gorsuch got it right in his dissent:

    In his one-paragraph dissenting opinion, Justice Neil Gorsuch called out his colleagues’ shoe-horning of the Mitchell decision into an “exigent circumstances” question. Gorsuch wrote that “the application of the exigent circumstances doctrine in this area poses complex and difficult questions that neither the parties nor the courts below discussed. Rather than proceeding solely by self-direction, I would have dismissed this case as improvidently granted and waited for a case presenting the exigent circumstances question.”

    In other words, in its decision, the majority disregarded the issue that was brought before them and chose to focus on a question that wasn’t argued.

    Furthermore, in this opinion, as in so many others, the court claimed for itself power to make law for Wisconsin, regardless of the laws enacted by the representatives of the people of Wisconsin.

    Let us summarize, the man was too incapaictated to give permission for a blood sample. First I would say that alone should convict the man. There are proven levels of alcohol that causes coma such as alleged. What kind of argument is it to say that the man is too drunk to stay conscious but too conscious to drive? Now they could have said that he was obviously too incapacitated to drive and the test was done to confirm it was alcohol and not some other medical condition. What if it were some other condition and the man died because they wouldn't take blood? The question then becomes, if the blood is drawn for medical reasons is law enforcement allowed to view the results, consider HIPPA.

    I think I will depart from my conservative friends and say that the SCOTUS is right and a blood sample could be taken and should be as part of the medical procedures. Driving isn't a right so maybe to be sure the states need to make one of the conditions of driving that a person is sober and can prove it. And it is not like that is saying guilty until proven innocent, the police would still need probable cause, such as weaving or erratic behavior or maybe even passing out.

    1. The outcome is always the opposite of the stated intent.
    2. Perception is reality
    3. Blame the other side of doing exactly what democrats are actually doing.
    4. Identity politics regardless if applicable.
    5. Promise things that are not possible and then blame the other side.
    6. Remain the victim, always.
    7. The democrat slave party way or the highway.
    8. Everything they touch is ruined.
    9. to democrats, pandering is a virtue.
